General purchase conditions

Below is the contractual document that will govern the acquisition of products and services through the website www.proquinorte.com, for which PROQUINORTE SA (hereinafter referred to as the provider) is responsible. By accepting this document, the user:

1. Has read, understands, and comprehends what is stated herein.
2. Is a person with sufficient capacity to contract or is acting as a representative of an entity.
3. Assumes all obligations set forth here.

These conditions will remain valid indefinitely and will apply to all contracts made through the website www.proquinorte.com by the provider.

The provider reserves the right to unilaterally modify these conditions, without affecting the goods or promotions acquired before the modification.

The sale of the products offered through the website is only for professionals and is not intended for individual purchases.

Identity of the parties

On one hand, the provider of the goods or services contracted by the user is:

On the other hand, the client or user is the person or entity registered on the website with a username and password, for which they have full responsibility for use and custody, being responsible for the truthfulness of the information provided to the provider.

Object of the contract

This contract aims to regulate the sales relationship formed between the provider and the client or user when the latter accepts, during the online contracting process, the corresponding checkbox.

The sales relationship involves the delivery, in exchange for a specified price publicly displayed on the website, of a specific product or service.

Contracting procedure

The contract will be made through the website www.proquinorte.com

Orders placed via the website will be made using the online sales platform of www.proquinorte.com, following the instructions detailed in that section. Before placing an order, the user must accept these general conditions.

For orders made through the website, to access the services provided by the provider, the client must register through the website by creating a user account. To do so, the client must voluntarily provide the required information.

The client will select a username and password, committing to use them diligently, not to make them available to third parties, and to notify the provider in case of loss, theft, or unauthorized access by a third party, so that the provider can immediately block the account.

The client may not choose a username with the intent of misleading others by identifying themselves as a member of the provider, nor use offensive, insulting, or generally unlawful language, or contrary to moral and good customs.

Once the user account has been created, in accordance with Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow these steps:

1.1. Select the products you wish to purchase. Each selected product will be automatically added to the "shopping cart".

1.2. Once the product(s) are selected, a summary of the order with all the selected products will be displayed on the "shopping cart" screen. If you have a discount voucher, check the corresponding box.

1.3. Identification. If this is your first time placing an order with us, check the box and click "Create account". A new window will appear. Enter your details (required fields: name, surname (if applicable), address, city, country, and email address), and create an account.

If you have already placed orders with us online, log in by entering your email address. Your details will automatically appear once you have entered your email address and password.

1.4. Address. If desired, modify the shipping or billing address if they differ from the ones provided during account creation. To continue, click "Next".

1.5. Shipping costs. Shipping is free for orders over ___ euros. For orders below __ euros, shipping is __ euros for deliveries within Bizkaia, and __ euros for the rest of Spain (Peninsular). For shipments to the Balearic Islands, Canary Islands, or outside Spain, please contact by phone. To continue, accept the general sales conditions and click "Next".

1.6. Payment method. Click "Bank Transfer" to pay for your purchase using this payment method. The order will not be shipped until the transfer is received in our bank account.

1.7. Order confirmation. Once the order is validated, we will send you a confirmation email. This message will include your name, order description, price, and shipping address. Our system records the date and content of the order, which will be subject to later verification by our services to ensure the order matches the product description at the time of placing the order.

Delivery of orders

The delivery of orders will be made to the delivery address freely designated by the client or user. The provider is not responsible if the delivery of the product or service is not made due to false, inaccurate, or incomplete information provided by the client, or if delivery cannot be made due to reasons beyond the shipping company, such as the recipient’s absence.

To ensure smooth delivery, it is important to indicate the person who will receive the order at the provided address.

In case of a delay in delivery, the user may contact the provider through any of the communication channels specified at the top.

At the time of delivery, it is advisable for the client to verify the conformity and condition of the order. If there is any issue with the items delivered or their condition, sign and note any discrepancies on the delivery receipt provided by the carrier.

Price and payment methods

The prices applicable to each product will be those published on the website and automatically applied during the last stage of the contracting process.

All prices published on the website, unless omitted or incorrectly transcribed due to errors, are valid and include the corresponding VAT. Shipping is free for orders over __ euros. For orders under __ euros, shipping is __ euros for deliveries within Bizkaia, and __ euros for the rest of Spain (Peninsular). These prices may be reviewed and modified at any time by the provider. However, the price will be respected if the order was processed before the price update on the website.

The provider offers a payment method via transfer.

Bank Transfer/Deposit into the provider’s account.

The order will not be shipped until we have received the payment in our bank account for the purchase amount.

The transfer fees will be borne by the buyer.

When making the transfer, you must include the order number and the full name of the customer as a reference.

Right of withdrawal

The user, who is considered a final consumer, has a period of fourteen (14) calendar days from the date of receipt of the product to withdraw from the contract without the need for justification (Article 71 of Law 3/2014 of March 27, General Law for the Defense of Consumers and Users).

In case of withdrawal, the user will be refunded all costs paid, once the goods are received in our warehouse and checked to be in perfect condition - and for sealed products, provided that the seal has not been broken. We will proceed to make the refund using the same payment method used by the user for the initial transaction. The user will not incur any expenses as a result of the refund.

The right of withdrawal does not apply to transactions between professionals.

Applicable law and jurisdiction

These conditions will be governed and interpreted in accordance with Spanish law in matters not expressly established. The provider and the user agree to submit any disputes arising from the provision of products or services under these Conditions to the Courts and Tribunals of Bilbao (Bizkaia).
